Mirena IUD lawsuit claims have begun to move forward in the multidistrict litigation recently established in U.S. District Court, Southern District of New York, Bernstein Liebhard LLP reports. According to court records, the litigation’s first Status Conference was held on May 17th, at which time appointments to Plaintiff’s leadership positions were discussed. So far, at least 50 Mirena lawsuits are pending in the Southern District of New York, all of which allege that the label for the IUD failed to provide adequate warnings regarding the risk of device migration and uterine perforations. Mirena Lawsuit Allegations
The Mirena IUD was approved by the U.S. Food & Drug Administration (FDA) as a birth control method in 2000. In 2009, Mirena’s approved uses were expanded to include treatment of heavy menstrual bleeding in women who wish to use an IUD as their method of birth control. Lawsuits pending in the federal Mirena litigation allege the IUD’s label only warns of the risk of migration upon insertion of the device. However, plaintiffs claim they were the victims of spontaneous migration that occurred long after the IUD was implanted, often necessitating risky Mirena removal surgery.
Court documents also indicate that more than 100 Mirena IUD lawsuit filings are pending in New Jersey Superior Courts. The New Jersey Supreme Court is currently considering a proposal to consolidate those claims before a single judge in Bergen County Superior Court.*
