Hundreds of Mirena IUD lawsuits (http://www.themirenalawsuitcenter.com) pending in a multicounty litigation underway in New Jersey’s Bergen County Superior Court are continuing to move forward, Bernstein Liebhard LLP reports. According to a Case Management Order dated February 12, 2014, the Court has extended the discovery deadline for certain matters until December 31, 2014. The Order also notes that these deadlines will be further discussed during the proceeding’s next Case Management Conference, which is tentatively scheduled for February 25, 2014. According to court documents, at least 579 Mirena lawsuits are now pending in the litigation underway in Bergen County Superior Court. All of these lawsuits allege that plaintiffs suffered uterine perforations and other serious injuries following spontaneous migration of the IUD, even when the device had been properly inserted by a healthcare provider. Among other things, plaintiffs claim that Bayer Healthcare Pharmaceuticals failed to provide adequate warnings regarding the possibility for spontaneous migration and related side effects.
Court records indicate that just over 400 Mirena IUD lawsuits that involve similar allegations have been filed in a federal multidistrict litigation now underway in U.S. District Court, Southern District of New York. (In re: Mirena IUD Products Liability Litigation, MDL No. 2434)
The Mirena IUD is a small T-shaped device made of soft flexible plastic that is inserted into a woman’s uterus where it releases levonorgestrel, a synthetic progestin, to prevent pregnancy for up to five years. Mirena is also approved to treat heavy menstrual bleeding in women who choose to use an IUD as their primary method of birth control. In 2009, the U.S. Food & Drug Administration (FDA) issued a warning letter to Bayer after the agency determined that certain of the company’s promotions made misleading claims about the benefits associated with the IUD, and downplayed the potential for serious Mirena complications.
