The product liability litigation surrounding its Yaz and Yasmin birth control pills continues to weigh on Bayer AG’s earnings, even as the company faces a growing number of Mirena IUD lawsuits in New Jersey Superior Court, Bernstein Liebhard LLP reports. According to Bayer AG’s third quarter earnings report, the company’s net income dropped 17.8% , as it set aside a further 200 million euros for Yaz and Yasmin lawsuits.*

Mirena IUD Lawsuits
Mirena was approved in 2000 as a contraceptive, and its approval was expanded in 2009 for the treatment of heavy menstrual bleeding for women who desire to use an IUD as contraception. The small, t-shaped, plastic device is inserted into a woman’s uterus by her healthcare provider, and works to prevent pregnancy by releasing a low dose of levonorgestrel (a synthetic progestin hormone) directly into the uterus. Among other things, the FDA took issue with marketing claims touting Mirena’s purported ability to improve a woman’s sex life and help her “look and feel great.”**** According to the FDA, Mirena side effects may include: ectopic pregnancy (a pregnancy in which the fertilized egg grows outside the uterus); intrauterine pregnancy (a pregnancy with Mirena in place); group A streptococcal sepsis; an infection called pelvic inflammatory disease; embedment of the device in the uterine wall; and perforation of the uterine wall or cervix.
