New Jersey Litigation Looks Ahead to Status Conference in January, Where Mirena Lawsuits will be Discussed, Bernstein Liebhard LLP Reports

A case management conference in the New Jersey litigation involving Mirena lawsuits ( is scheduled to take place next month in Bergen County Superior Court, Bernstein Liebhard LLP reports.

According to a Calendar posted on the Court’s website, the meeting will convene on January 20th, 2015 at 2:00 p.m., at which time parties will address issues related to claims over the IUD. The proceeding now includes almost 1,400 Mirena lawsuits that similarly accuse its manufacturer, Bayer Healthcare Pharmaceuticals, of failing to adequately warn about its potential to spontaneously migrate away from the uterus and into other parts of the body, which may lead to perforation and other IUD complications.

Mirena Lawsuits

According to court documents, at least 1,375 Mirena IUD lawsuits have now been filed in Bergen County Superior Court on behalf of women who similarly accuse Bayer of failing to warn about serious side effects that may stem from use of the birth control implant. Plaintiffs in these cases similarly allege that the manufacturer overstated its benefits and downplayed its potential for side effects, which they were scolded for in 2009 by the U.S. Food and Drug Administration (FDA). The federal agency issued a Warning Letter that year that took issue with certain marketing claims of Mirena they found to be misleading to women.*

In addition to Mirena lawsuits filed in New Jersey’s IUD litigation, where attorneys at Bernstein Liebhard LLP are actively filing claims, court documents in a federal multidistrict litigation established in New York show that 1,121 cases have been filed.
