The multicounty litigation recently established for Mirena IUD lawsuit claims in New Jersey’s Bergen County Superior Court continues to move forward, Bernstein Liebhard LLP reports. According to court records, the next Case Management Conference in the New Jersey proceeding has been scheduled for July 1st before Superior Court Judge Brian R. Martinotti. Mirena Lawsuit Allegations

The Mirena litigation underway in New Jersey was established by an Order of the New Jersey Supreme Court on May 13, 2013. All of the Mirena lawsuits pending in the litigation allege that the plaintiffs suffered injuries and/or damages as a result of migration of the IUD. According to court documents, plaintiffs further allege that the Mirena label only warns of the risk of migration upon insertion of the device, and fails to address the risk of device migration that may occur long after the Mirena IUD has been implanted. According to a Case List posted on the court’s website, 19[ Mirena side effects claims have already been transferred to Bergen County Superior Court. However, in an application filed with the New Jersey Supreme Court on March 6th, plaintiffs listed at least 60 Mirena lawsuits that had been filed in the state. They further asserted that numerous additional Mirena claims would be filed in the state’s courts in the near future.

Court records also indicate that at least 50 Mirena IUD lawsuits have been filed in a federal multidistrict litigation underway in U.S. District Court, Southern District of New York. That litigation’s first Status Conference was held on May 17th. According to an Order dated May 22nd, a proposal naming lawyers to serve on the Plaintiffs’ Steering Committee is to be submitted to the Court by June 17th.
