The U.S. Judicial Panel on Multidistrict Litigation (JPML) has ordered that all federally-filed Mirena lawsuits be transferred to the U.S. District Court, Southern District of New York, for pretrial proceedings. According to a Transfer Order dated April 8th, the Panel has tapped Judge Cathy Seibel to preside over the federal Mirena litigation. Consolidation of the federal Mirena IUD lawsuits in the Southern District of New York will, “serve the convenience of the parties and witnesses and promote the just and efficient conduct of this litigation,” the Order stated. Mirena IUD Lawsuits
According to the JPML’s Transfer Order, more than 40 Mirena lawsuits have been filed in 17 federal jurisdictions. All of the claims allege the Mirena IUD migrated away from its original position in the uterus, leading to uterine perforations and other serious Mirena complications. Plaintiffs further allege Bayer Healthcare Pharmaceuticals failed to provide adequate warnings regarding the risk of device migration and related side effects. While Plaintiffs’ original Motion for Transfer requested that the Mirena litigation be established in U.S. District Court, Northern District of Ohio, the Panel held that the Southern District of New York was the more appropriate venue because Bayer is located in New York and its corporate affiliates are located nearby in New Jersey, Connecticut and Pennsylvania.
In addition to the Mirena lawsuits currently pending in the federal litigation, dozens of others have been filed in state courts throughout the country. Court documents indicate Bayer petitioned the New Jersey Supreme Court last year for the establishment of a consolidated litigation in Middlesex County Superior Court for Mirena claims filed in that state. While the request was rejected, plaintiffs in Mirena IUD lawsuits filed in New Jersey recently asked the Court to reconsider that request.*
