As Mirena IUD lawsuits continue to mount in courts throughout the U.S., Bernstein Liebhard LLP notes a lawsuit recently filed in Canada includes many of the same allegations put forth by U.S. plaintiffs. According to an April 23rd filing with the Nova Scotia Supreme Court, the Mirena lawsuit seeks class action certification on behalf of all Canadian women who have allegedly suffered serious Mirena IUD side effects, including migration of the device and uterine perforations. The Mirena IUD was approved by the U.S. Food & Drug Administration (FDA) as a birth control method in 2000. In 2009, Mirena’s approved uses were expanded to include treatment of heavy menstrual bleeding in women who wish to use an IUD as their method of birth control. On April 8th, the U.S. Judicial Panel on Multidistrict Litigation (JPML) ordered that all federally-filed Mirena lawsuits be transferred to the U.S. District Court, Southern District of New York, for pretrial proceedings. According to court documents, these claims allege that Bayer has a history of overstating Mirena’s benefits and downplaying its serious risks. Among other things, the lawsuits point out that the company received an FDA Warning Letter that cited misleading claims made in a Mirena promotional campaign.* (In re: Mirena IUD Products Liability Litigation, MDL No. 2434)
Additional Mirena IUD lawsuits have also been filed in state courts throughout the country. Court documents indicate Bayer petitioned the New Jersey Supreme Court last year for the establishment of a consolidated litigation in Middlesex County Superior Court for Mirena claims filed in that state. While the request was rejected, plaintiffs petitioned the Court on March 6th to reconsider that request.**
