DrugNews: Judge Refuses Bayer Request to Dismiss Mirena Lawsuit
Chicago, IL (PRWEB) November 12, 2013 -- The DrugNews.net birth control safety center is alerting women using the Mirena IUD contraceptive of new information on the site. As the number of lawsuits alleging the devices caused perforation injuries grows, a judge recently denied Bayer’s attempt to dismiss a woman’s case*.
DrugNews was created to give those using popular prescription drugs or medical devices the latest safety alerts, recalls, studies and legal news. Patients can avoid potential dangers, see if others are experiencing similar side effects and decide if they need legal advice.
The resource center contains warnings from health experts about possible injury from Mirena IUDs. The FDA has advised that patients can suffer perforation of reproductive organs during implantation of the devices**.
DrugNews has also added a study from the Society of Laparoendoscopic Surgeons warning that Mirena IUDs can dislodge and cause perforation of the uterine wall after installation***. FDA records show the agency has already received 70,072 reports of Mirena side effects, with as many as 6,000 involving device dislocation or uterus perforation****.
Due to the number of patients filing a Mirena lawsuit, federal cases have been consolidated to a special multi-district litigation court in New York (In Re: Mirena IUD Products Liability Litigation, MDL No. 2434, Southern District New York). The latest court records show the number of cases filed has increased to 211 as of October 17*****.
Now, DrugNews has learned that federal Judge Joseph H. McKinley Jr. of Kentucky denied a motion to dismiss by Bayer Healthcare Pharmaceuticals, instead allowing the plaintiff to amend a complaint that was improperly pled*.
Anyone who suffered perforation or required surgery while using a Mirena IUD is urged to speak with a lawyer about their legal options. However, DrugNews only recommends lawyers who are already handling Mirena lawsuits.
