New York personal injury lawyer Steven J. Schwartzapfel said today he’s hopeful that two new driving initiatives -- a law requiring drivers to yield for emergency vehicles and stiffer penalties for texting behind the wheel -- will result in safer New York roads.

“We at Schwartzapfel Partners hope the state legislature’s focus on safety through these recent laws -- the texting ban with its increased penalties, and requiring people to make way for emergency personnel -- will remind drivers to focus and lead to fewer people injured in accidents,” Schwartzapfel said.

The law prohibiting drivers from using portable electronic devices, such as cell phones, to send text messages or e-mails while driving went into effect in November 2009, Schwartzapfel pointed out, and followed similar local ordinances. The more recent legislation adds a driver’s license points penalty to the previous fine of up to $150.

New York’s Ambrose-Searles “Move Over Act” went into effect January 1. It requires motorists to slow down and, on multi-lane highways, to move to the left if it is safe to do so when they approach stopped emergency vehicles that have red flashing lights. Violations can result in 2 or 3 penalty points and a fine of up to $275.

“Of course, laws and their penalties are intended to shape behavior, but not everyone is so easily educated,” Schwartzapfel continued. “Deadly accidents continue to be caused by drivers not paying attention to the road as they instead engage in any number of inappropriate activities. And when these accidents hurt others, the injured parties have the right to be compensated for medical expenses and, in many cases, for their pain and suffering.”
