This New York birth injury lawsuit, which was filed in the Supreme Court of the State of New York, County of Westchester and which was assigned to the Honorable Judge Lefkowitz, was assigned a case number of A06069 and was entitled, J.S., An Infant by his Mother and Natural Guardian, S.B. v. J.F.J.C., M.D. and NEW YORK PRESBYTERIAN HOSPITAL, concerned the diagnosis of cerebral palsy that was relayed to the plaintiff’s family after a difficult birth of the plaintiff.
The case concerned a premature birth that the child endured after his mother had reported for medical observation and treatment several times prior to his delivery on December 2, 2003 at the defendant hospital. The child was born prematurely at 32-33 weeks and was subsequently diagnosed with spastic quadriplegic cerebral palsy. The prognosis for the child is that he will never be able to obtain gainful employment and will never be able to live on his own.
The basis of the claim made by the New York birth injury lawyers from Fitzgerald & Fitzgerald was that the defendants did not perform at a standard level in that not enough steps were taken to prevent this premature birth despite some indications of problems that the mother was experiencing during her gestation period. As a result, the New York birth injury lawsuit alleged, the child was born with this condition which is permanent in nature. The case settled for $5,350,000.00.
