The court documents went on to state that the plaintiff infant showed no signs of life after being born and that he was rushed to NICU immediately. The infant’s condition did improve and he was released two weeks after being born. However, the mother began to notice that the baby could not hold up his head and he did not make any attempts to sit up or roll over.

In addition, the plaintiff is now bound to a wheelchair and incapable of taking care of himself.

Rather than litigate the matter, the defendant settled the lawsuit for damages in the amount of $3 million.
