Specifically, the lawsuit that was filed in response to this alleged negligence on the part of the defendant was filed in the New York County Supreme Court. It was assigned a case number of 99001A and the plaintiff was an individual infant whose parents were named in the case as his guardians. The defendant named in the case was a hospital, and the case sought damages in response to severe and permanent injuries allegedly suffered as a result of the defendant’s substandard medical care.
According to the court documents, the infant plaintiff’s mother reported to the defendant hospital complaining of spotting and contractions at 28 weeks of gestation. The mother was provided with a fetal heart monitor and given medication, but 12 hours later she was rushed into emergency delivery and gave birth to the infant plaintiff by way of emergency C-section. The infant plaintiff was immediately intubated and transferred to the NICU.
The court documents went on to state that the infant plaintiff exhibited neonatal neurological syndrome and was ultimately hospitalized for a period of 2.5 months. The documents stated that during this period of hospitalization, the infant plaintiff experienced Tachycardia, tachypnea, bradycardia, anemia, a staph sepsis and a serratia infection. After the infant plaintiff was discharged, he suffered from bilateral inguinal hernia, acute laringotracheitis with difficulty breathing, V-pattern esotropia and strabismus.
The court documents argued that the defendant hospital, its agents and its employees departed from generally good and accepted medical practice by failing to delay premature labor and to timely administer medicine to inhibit premature labor which resulted in catastrophic and permanent injuries to the infant plaintiff. Those injuries included diagnoses of cerebral palsy and mental retardation.
Rather than proceed to trial, the New York medical malpractice lawyers at Fitzgerald & Fitzgerald were able to successfully negotiate an out-of-court settlement with the defendant hospital in the amount of $4,900,000.00. The attorneys at the firm subsequently dismissed the lawsuit and the matter is now considered closed.
