The case was filed on behalf of an infant male and against a defendant hospital in the county, and the reason that the claim was filed was because it was alleged that the plaintiff suffered from spastic quadriplegia because of the negligence of the defendant in failing to provide a proper level of medical care.
According to the court documents, the plaintiff’s mother reported to the defendant hospital at 28 weeks of gestation after suffering through what she said were 12 hours of labor pains. She was admitted at approximately 10 a.m. and she reportedly had a history of induced abortions and vaginal bleeding during her previous pregnancies. She presented at 5-6 centimeters dilated shortly after admission and she was suffering from bulging membranes.
The infant plaintiff was delivered vaginally with assistance a short time later, but he was struggling in terms of its respiratory capabilities and he was intubated for a period of several weeks according to the court documents. During the course of his neonatal care in the NICU, the plaintiff infant suffered from respiratory distress syndrome and had to be re-intubated. The court documents went on to state that during this period of care, the infant plaintiff suffered from apnea and hyperbilirubinemia, requiring phototherapy and exchange transfusion.
The court documents ultimately alleged that one of the problems that the infant plaintiff encountered was that his mother was left in a hallway unattended for a prolonged period of time by the defendant hospital, although a review of the nurse’s notes did not confirm this allegation.
