New Jersey trial attorney Adam Slater of the law firm Mazie Slater Katz & Freeman, won an appeal affirming a New Jersey State Court jury verdict of $2.1 million for a woman who was struck by a Hudson County owned van, in Carol Lintao v. Patricia Livingston, County of Hudson, Superior Court of New Jersey, Law Division, Hudson County, Docket No. HUD-L-5801-06.
The $2.1 million jury verdict was awarded to the plaintiff, who had been crossing a Bayonne, New Jersey street when the van, driven by a Hudson County, New Jersey employee, struck her while making a left turn. The plaintiff suffered multiple injuries, including pelvic floor damage, pudendal nerve damage, a displaced coccyx bone, a fractured wrist, and neck and back injuries. The pelvic floor is the foundation of muscles and structures supporting the organs of the pelvis. The pudendal nerve is a nerve that exists in the pelvic floor region and innervates and contributes to the function of the organs of the female pelvis and other functions.
Notably, Mr. Slater successfully argued that the defense attorney should be prevented from arguing that the plaintiff’s pre-existing medical conditions should be described to the jury since Mr. Slater had gotten the defense experts to admit that those conditions were not the cause of the problems at issue. The decision by the New Jersey Appellate Division is notable for the legal ruling confirming that Mr. Slater’s argument was correct, and that the Trial Judge properly shifted the burden of proof to the defense to prove that the plaintiff’s injuries were pre-existing, which the defense could not prove.
