The court documents went on to state that during her second prenatal visit, the plaintiff’s mother showed symptoms of a urinary tract infection, or a UTI, and that this condition was not properly diagnosed.

Specifically, the lawsuit at issue was filed in the Queens County Supreme Court and it was assigned a case number of 94393A. The case was filed on behalf of an individual male plaintiff who was an infant at the time of the filing and the defendant was a local medical facility. The case was filed in pursuit of a recovery of damages that arose because the infant plaintiff was permanently injured as a result of the alleged negligence of the defendant.

According to the court documents, the plaintiff was born at the defendant hospital via vaginal birth when the mother had reached 27 weeks of gestation. The plaintiff’s mother had also received prenatal care at the defendant hospital. The plaintiff’s mother had suffered through two previous spontaneous abortions and she was dealing with prenatal diabetes while pregnant with the infant plaintiff.

The court documents went on to state that during her second prenatal visit, the plaintiff’s mother showed symptoms of a urinary tract infection, or a UTI, and that this condition was not properly diagnosed. 11 days prior to the infant plaintiff’s birth, the mother reported once again to the defendant hospital with diabetes complications and a UTI. The documents allege that no antibiotics were administered at that time.

The court documents went on to state that when the plaintiff was born, he was described as blue, pale and floppy with occasional spontaneous respiration. He was intubated and admitted to the NICU, and he was diagnosed with conditions including Klebsiella Sepsis and hydrocephalus. Ultimately, the infant plaintiff underwent multiple procedures for Respiratory Distress Syndrome, Bilateral Pneumothoraces, Anemia, Metabolic Acidosis, Patent Ductus Arteriosus, Hyperbilirubinemia, and Phenobarbital Toxicity.

Rather than fully litigate the matter, the two sides were able to successfully negotiate a settlement that paid the plaintiff damages in the amount of $4 million. The case was subsequently dismissed and the matter is now considered closed by all of the parties involved.
