“It’s about time,” said Joshua Denbeaux, of the law firm Denbeaux and Denbeaux, of the recent administrative order handed down by General Equity Judge Mary C. Jacobson of the Mercer Vicinage to protect the integrity of foreclosures filings in New Jersey.
Joshua Denbeaux, a Westwood, New Jersey, attorney leading the fight for homeowners victimized by banking irregularities such as “robo-signing” for the past two years, responded to Monday's December 20th, 2010 filing in the Superior Court of New Jersey Chancery Division - General Equity Part Mercer County, Docket No. F-059553-10 naming six national banks who must show cause why the court should not suspend the processing of thousands of uncontested residential mortgage foreclosure filings.
“Robo-signers” are mortgage lender/service employees who sign hundreds—in some cases thousands – of affidavits submitted in support of foreclosure claims without any personal knowledge of the information contained in the affidavits. “Robo-signing” can also refer to improper notarizing practices or backdating.
Named in the administrative order are Ally Financial, formerly GMAC; BAC Home Loan Servicing LP, a subsidiary of Bank of America; JP Morgan Chase's Chase Home Finance LLC; OneWest Bank, formerly IndyMac Federal Bank, Wells Fargo Financial New Jersey and CitiResidential Living, a subsidiary of Citibank, who all must show cause why the court should not suspend the processing of uncontested residential mortgage foreclosure filings.
“The abuses by these banks have caused financial hardship, and suffering for many of the home owners coming to me looking for help. I don’t know why it’s taken so long for this to come to light, but it just goes to show that the wheels of justice, though they turn slowly at times, they do turn”, said Joshua Denbeaux.
“Unfortunately, the majority of the foreclosures in New Jersey have been uncontested due to either the expense of getting a lawyer, or due to the lack of knowledge on the part of the homeowner. It is important to locate an attorney who specializes in foreclosure law. This means many New Jersey homeowners are at risk – this is what I’ve been fighting against for the past two years”, said Joshua Denbeaux.
The six lenders must appear on January 19th in state Superior Court in Trenton to “demonstrate affirmatively that there are no irregularities in their handling of foreclosure proceedings”, according to the order handed down on Monday.
