Texting while driving has quickly become a dangerous contributing factor in automobile accidents

A Manhattan personal injury lawyer who focuses on helping motor vehicle accident victims this week encouraged the state Assembly to make texting while driving a ticketable offense.

“There is no doubt whatsoever that it is appropriate and necessary that legislators make it clear that texting while driving is wrong and should be legally punished,” Resnick added.
The Assembly passed legislation in November that made texting while driving a secondary offense, meaning it alone was not enough for a law enforcement official to stop a driver. The Assembly has considering a law that would make texting while driving a primary offense, like speeding or running a red light, which can result in a traffic ticket.
As many as 40 percent of drivers in some surveys admit to texting while driving, the Journal News in White Plains, N.Y., reported this month. Evidence of the danger of texting while driving has mounted as it has become more commonplace.
The state Department of Motor Vehicles says distractions are a factor in almost 18 percent of reported accidents in New York. A 2009 Virginia Tech Transportation Institute study that used video cameras to observe long-haul truckers' driving habits showed a correlation between texting and crashes.
“Texting while driving is a relatively new habit in our society,” Resnick said. “It’s a bad habit that needs to be broken, and the state Assembly should take the lead, for the safety of all New Yorkers.”
