Under New York's construction safety laws, the safety of workers who are exposed to gravity related risks must always be ensured.

A 54-year old construction worker died after losing his balance and falling out of a third-floor window, reported the New York Daily News(5/24/2012).

He was painting near a floor-to-ceiling window in an upper East Side apartment when the construction accident fall occurred, the New York tabloid said.

In New York, falls consistently account for one of the highest number of accidents in the construction industry. According to the New York Department of Buildings, 152 construction workers were injured on the job and five others died in 2011. Approximately 41% of the construction related accidents were falls.

New York construction accident lawyers understand that the use of fall arrest systems, guardrail systems, safety nets and other safety devices can prevent many construction accident injuries and deaths from falls.

“Under New York's construction safety laws, the safety of workers who are exposed to gravity related risks must always be ensured. They must always be provided with proper protective devices in New York,” construction accident lawyer Perecman, the former head New York construction accident lawyer for the New York State Trial Lawyers Association and a lecturer on construction accident law, said.

New York's Labor Law Sections 200, 240 and 241 require that painters be provided with proper protection when doing their job.

“Fall hazards are foreseeable. They can be identified and eliminated, or exposure to them can be eliminated or controlled before they result in injuries or death,” said New York construction accident lawyer, Perecman, founder of The Perecman Firm, one of New York’s construction accident law firms. “Construction accidents can and should be prevented.”

In New York, construction accident lawyers at The Perecman Firm have recovered millions of dollars in verdicts and settlements for injured construction workers and/or their families.
