Bettina Yanez, Orange County Adoption Attorney at Yanez & Associates, launched a new video titled, “How can a stepparent adopt a child from a previous relationship?” A Stepparent Adoption is when one of the biological parents has remarried and the new spouse wishes to adopt the child from a previous relationship.

The adoption will be granted if the court finds that the adoption is in the child’s best interest.

Bettina Yanez, Orange County Adoption Attorney at Yanez & Associates, launched a new video titled, “How can a stepparent adopt a child from a previous relationship?” A Stepparent Adoption is when one of the biological parents has remarried and the new spouse wishes to adopt the child from a previous relationship.

Attorney Bettina Yanez produced a video explaining the process of how stepparent adoptions can be achieved when one of the natural parents has remarried and the new spouse wants to adopt the child from a previous relationship.

Bettina Yanez explains that a stepparent wishing to adopt should first try to get the permission of the natural parent, this will ease the adoption procedure. If there is an agreement the adoption agreement will be executed by the parties. If an agreement cannot be attained the party seeking the adoption will need to file an action in court to have the parental rights terminated of the Natural parent in order to free the child for adoption. The parental rights must be terminated in order for the process to proceed. At the court hearing the biological parent who rights are being terminated may have counsel.

Bettina further explains, If a party is trying to free the child from the Mother or from a assumed father, one will need to file an Abandonment Petition in order to liberate the child from the child’s current parental custody.

If the child is of age, the child will be interviewed and a home visit will usually be performed before a court hearing. The Stepparent is expected to appear for the hearing, as well as the biological/custodial parent and the child to be adopted. The child will need to agree to the adoption if her or she is 12 years of age or older. If the court finds that the adoption will be in the best interest of the child, the court will grant the adoption. If one does not know the whereabouts of the biological parent one may have to give notice by publication in order for the adoption hearing to take place.

At the hearing once approved the party will obtain a certified copy of the Order of Adoption.
