An automobile accident resulting in extensive surgery for the client, resulted in an award of $1.275 million in damages to former volunteer firefighter Paul Tully. As part of their commitment to those wrongfully injured, Martin, Harding, & Mazzotti represented Tully in his case. Tully was struck while driving on Genesee Street by Keith Chase who was exiting the driveway of the NYE Ford facility. Chase was driving a vehicle belonging to Brian Guldy when he failed to look left and struck Tully’s vehicle. Chase, Guldy, and NYE Ford were all named in the lawsuit; the insurance carrier for NYE Ford will pay all $1.275 million in damages to Tully.
“Making sure persons of accidents like this one receive the compensation they are entitled to is an important aspect of what we do,” managing partner, Paul Harding said. “While this was an unfortunate accident, Mr. Tully is a contributing member of his community, and those responsible should be held accountable so that he and his family can get back to some normalcy without worrying about bills and other expenditures.”
Tully was a volunteer firefighter who has not been physically able to return to his work since the accident occurred. The Jury awarded Tully $675,000 for past pain and suffering, $200,000 for future pain and suffering, and $400,000 for future medical care and treatment. Martin, Harding & Mazzotti worked to secure the client these damages after an offer of $150,000 by the defendants.
