The first federal trial of a DePuy Pinnacle hip replacement lawsuit (http://www.consumerinjurylawyers.com/depuy-pinnacle/lawsuit) now underway in the U.S. District Court, Northern District of Texas has moved into its third week, Bernstein Liebhard LLP reports. According to court documents, this week’s witnesses included a DePuy Orthopaedics vice president who discussed the safety testing the company performed on the metal-on-metal Pinnacle hip. * (Herlihy-Paoli v. DePuy Pinnacle Hip Replacement Litigation
Court documents indicate that more than 6,000 claims are now pending in the Northern District of Texas, all of which allege injury due to a metal-on-metal version of the Pinnacle hip that utilizes the Ultamet liner. The case currently at trial was filed on behalf of a 58-year-old Montana woman who underwent revision surgery within two years of receiving two all-metal Pinnacle hips. Among other things, the lawsuit alleges that exposure to metal debris shed from the implants caused the Plaintiff to suffer a range of serious complications, including cobalt blood serum levels 85 times higher than normal. Johnson & Johnson and its DePuy Orthopaedics subsidiary announced in May 2013 that they would stop selling metal-on-metal hip implants, including the all-metal version of the Pinnacle hip replacement that is at the center of this litigation. The companies have asserted that the move was driven by commercial concerns rather than safety issues. However, the announcement followed an alert published by the U.S.Food & Drug Administration (FDA) in January 2013, which warned that metal-on-metal hips were more likely to fail early than those made of other materials.*
