Bellwether trials will provide valuable insights into how juries might rule in similar Pradaxa lawsuits.

Bernstein Liebhard LLP notes that the federal judge overseeing hundreds of Pradaxa lawsuits in the U.S. District Court, Southern District of Illinois, has issued a new Case Management Order regarding the litigation’s bellwether trials. Among other things, the April 9th Order establishes criteria for selecting cases for the Pradaxa litigation’s first trials, and establishes a discovery schedule for the early trial cases. Court documents indicate the first federal Pradaxa lawsuits will begin going to trial in September 2014. (In Re: Pradaxa (Dabigatran Etexilate) Products Liability Litigation – MDL No. 2385)

“Bellwether trials will provide valuable insights into how juries might rule in similar Pradaxa lawsuits. We are pleased to see that the court is moving forward with the selection of these important cases,” says Bernstein Liebhard LLP, a nationwide law firm representing victims of defective drugs and medical devices. The Firm is currently offering free legal evaluations to victims of alleged Pradaxa side effects.

Pradaxa Side Effects
Pradaxa was approved by the Food & Drug Administration (FDA) in October 2012 to prevent strokes in people with a heart-rhythm disorder known as atrial fibrillation. According to a recent report, regulators in several countries have issued Pradaxa side effect alerts since the drug was first brought to market*. One of the major issues with Pradaxa is the fact that there exists no readily available antidote for internal bleeding that can sometimes occur in patients treated with the drug. Dialysis can be used to remove Pradaxa from the blood stream. However, a study published last May in the journal, Neurology, found this treatment is risky and may not be administered in enough time to stop this potentially deadly Pradaxa side effect.**

According to a QuarterWatch Report from the Institute for Safe Medicine Practices (ISMP), an analysis of hemorrhage cases reported to the FDA during the second quarter of 2012 found that Pradaxa bleeding is 5 times more likely to result in death compared to warfarin bleeding.*** In 2011 alone, the FDA received reports of 542 deaths and 3,781 side-effect incidents tied to the drug, according to Bloomberg.

Court documents indicate that 359 Pradaxa lawsuits are currently pending in the federal Pradaxa litigation. Among other things, the lawsuits alleged that Boehringer Ingelheim sold Pradaxa despite knowing it could cause fatal bleeding in some patients, and failed to adequately warn that there was no readily-available treatment for this Pradaxa side effect.

Victims of serious Pradaxa side effects may be eligible to collect compensation for their medical bills, lost wages, pain and suffering and more.
