Judge Issues Orders in Pradaxa Internal Bleeding Lawsuit

New Case Management Orders in Pradaxa product liability lawsuit requires depositions and information from the German drug maker's foreign entities.

Judge David Herndon, the federal judge in the Pradaxa Products Liability Litigation (United States District Court, Southern District of Illinois, MDL no. 2385) entered Case Management Orders calling for the participation of the German Boehringer entities (those involved in the production of Pradaxa) in the pending Pradaxa lawsuit.    The Pradaxa product liability lawsuit alleges that the drug's manufacturer did not adequately inform users of the risk of and danger from internal bleeding after using the Pradaxa. Mark Niemeyer, of the law firm of Onder, Shelton, O'Leary & Peterson, who was recently named Co-Liaison Counsel in the Pradaxa litigation, explained that the effect of these orders is that Defendant Boehringer's foreign witnesses and documents that relate to Pradaxa will be accessible to the Plaintiff's Leadership Counsel prosecuting the litigation, and Boehringer will not utilize foreign legal obstacles to block the production of essential information. The Pradaxa Case Management Orders allow for direct filing and service against the foreign defendants and deposition of foreign witnesses.

Although the Pradaxa label warns of the risk of internal bleeding, including gastrointestinal bleeding, the FDA issued a Safety Communication December of 2011 stating that post market reports indicate that “serious or even fatal” bleeding problems may be more common than previously indicated. Lawsuits have since been filed for Pradaxa internal bleeding claims, including internal bleeding deaths, and hemorrhagic stroke cases.
