Columbus, OH (PRWEB) October 29, 2012

Wright & Schulte LLC, a leading nationwide law firm and Ohio personal injury law firm, announces they have filed a new Imprelis lawsuit on behalf of Columbus, Ohio, property owners who sustained significant damage to trees on their property, allegedly due to DuPont’s Imprelis herbicide. This latest Imprelis tree damage lawsuit was filed in the U.S. District Court, Southern District of Ohio, Eastern Division (Case No. 2:12-cv-00965-GCS-EPD).

According to the complaint, Imprelis herbicide was introduced by DuPont in October 2010 and marketed as a safe and effective way to treat the most common and hard to kill broadleaf weeds present in turf grass without any negative impact on surrounding plants. The lawsuit alleges that DuPont’s representation of Imprelis as being environmentally friendly and safe to use is simply not the truth. Plaintiffs assert that in its relatively short time on the market, DuPont’s Imprelis has proven to be a frighteningly effective tree killer.

According to the lawsuit, Imprelis was applied to the Plaintiffs law one time on May 31, 2011. On September 22, 2011, a certified arborist visited the property and discovered damage to trees including but not limited to browning, curling, twisting, and death on at least three trees including one mature White Pine. The complaint alleges that DuPont’s Imprelis product directly and proximately caused serious damage, death, and significant injury to plants and trees throughout Plaintiffs’ property.

The U.S. Environmental Protection Agency (EPA) issued a Stop Sale and Removal Order for Imprelis in August 2011, after investigating hundreds of reports of Imprelis tree death throughout the Northeast and Midwest, including reports from Minnesota, Indiana, Illinois, Ohio, Michigan, Pennsylvania, Maryland, Virginia, Delaware, Wisconsin and West Virginia. By the time Imprelis was pulled from the market, it had killed or damaged thousands of ornamental landscape trees, including Norway spruces, eastern white pines, conifer trees, willow trees, poplar trees, deodora cedars, and balsam fir trees. Thousands of property owners have since filed Imprelis lawsuits seeking compensation for their damaged and dead trees. On October 19, 2012, DuPont reached an agreement to settle thousands of Imprelis lawsuits currently filed in Pennsylvania federal court. Wright & Schulte LLC is currently representing some 300 property owners in Imprelis lawsuits filed outside of the federal litigation in Pennsylvania. Richard Schulte, a partner with Wright & Schulte LLC, recently told the Columbus Dispatch that the offers DuPont has made to property owners via that Imprelis compensation program are inadequate. The firm continues to offer free Imprelis lawsuit evaluations to property owners who suffered damage to landscape trees due to Imprelis, including any claimant dissatisfied with the terms of DuPont’s Imprelis claims program, or the proposed settlement in the Pennsylvania litigation.
