In the lawsuit Bernier claims he was implanted with the DePuy Pinnacle hip in 2008. He allegedly developed metal poisoning from the implant and suffers pain and disability.

As BusinessWeek reported in August 2012, Johnson & Johnson agreed to pay $600,000 to settle three lawsuits on its DePuy Hip replacement systems (Clark County District Court, case no. A-11-636272). The lawsuits allege that plaintiffs had the hip replacement removed after experiencing severe adverse events.
