Wilhelm has obtained $650,000 for a 35-year-old home health care attendant, who broke her ankle after tripping and falling on a metal ramp that was placed against a step leading into and out of a building. The woman filed a lawsuit (Supreme Court/Kings County, Index #27825/09) against the building owner stating that they created a hazardous condition for visitors to their property. The plaintiff testified that when she arrived at the building the morning of Sept. 21, 2009, the ramp was not in place. However, when she left the building later that day, the ramp had been placed against the step without her knowledge.
The building owner was sued based on the negligence of their employers in allowing the metal ramp to be placed against the step when not in use, said New York personal injury lawyer Kenneth A. Wilhelm. In addition, the building owner failed to provide a warning of the ramp to visitors and guests of the building, he said. "As a result of the trip-and-fall accident, our client sustained an ankle fracture that required an operation," Wilhelm said.
The building owner's insurance company initially offered $50,000 before trial and $90,000 during the trial, Wilhelm stated. "At the end of the trial on liability, we were able to establish a 100 percent verdict against the building owner. They then made an offer of $450,000. When we rejected that offer during the trial on the damages portion of the case, they settled for $650,000."
Wilhelm said this case is indicative of the hard work and tenacity it takes to help an injured client obtain fair compensation.
