The auto accident attorneys at d'Oliveira & Associates recently recovered a settlement of over $82,000 for one of its clients. This client was traveling through an intersection and was injured when another vehicle ran a stop sign and entered the intersection and collided with her passenger side. The resulting accident left her vehicle totaled and the client sustained a contusion to the lower back of her leg, lower back injuries, and pain to the hip and neck.
Additionally, this client was pregnant and had a schedule caesarean section ("C-Section,") following the accident. The client had to visit and undergo numerous tests at both the hospital for her injuries and with her OBGYN for potential complications with her pregnancy.
The client contacted the offices of d'Oliveira & Associates who sought damages for her for personal injuries and property damage to here vehicle. Attorney Cara Gallucci at their firm was able to negotiate a settlement out of court for $85,000.
The U.S. Department of Transportation's National Highway Traffic Safety Administration's recent study investigated the critical factors behind auto accidents occurring at intersections. The study reported that out of the 787,236 intersection crashes, roughly 96% of the accidents were as a result of critical reasons attributable to the driver, such as negligence. Less than 3% of the crashes could be attributed to factors outside the control of the driver such as blocked views, environmental causes or vehicular problems.
Attorney Gallucci stated “This was a question about the monetary compensation that my client deserved. There was never a question that the other driver was at fault. The issue was getting the insurance company to make an offer that fairly reflected the damages suffered by my client, and getting her what she deserved.”
Attorney Paul d’Oliveira stated “Fortunately there was enough insurance to compensate the client for her injuries as far too often in cases like this the other driver only carries the minimum amounts required in Massachusetts, which is $20,000 and in RI the minimum is $25,000. It is important that people carry more underinsurance coverage on their auto policies in case the other driver only has the minimum amount required by law.”
