On January 11, Rapid Recovery Solution, a long island based collection agency, offers additional comments in response to an article published by the Echo Press regarding advice on handling debt and collections.

Although the article professes that it is legitimate for debt collectors to contact debtors who owe unpaid bills, it appears that some debt collectors will forgo a person’s rights in order to collect money. According to the Echo Press, “Debt collectors seek to reclaim funds on past-due accounts on behalf of creditors, businesses or individuals. But sometimes debt collectors go too far, or in some cases even turn out to be an identity thief trying to get you to divulge personal or financial information, such as your Social Security, bank or credit card numbers.” The article continues by providing tips to avoid being harassed by a threatening debt collector.

According to the federal Fair Debt Collection Practices Act (FDCPA), collectors “Cannot threaten you with arrest”, “Are not allowed to make idle threats, express or implied, or use abusive language”, “Should not discuss consumers' accounts with unauthorized third parties”, and “Must investigate the validity of a dispute over a debt.”

John Monderine is the CEO of the collection agency Rapid Recovery Solution. “People should certainly be aware of their rights when it comes to collection. There is a lot most people who owe some debt do not realize and so they will put up with threatening collection tactics when they do not have to,” says Monderine. “One particular tip listed in the article that I agree with is to not ignore the collector. Even if you don’t believe you owe the debt, it’s best to handle the situation rather than ignore it. If you ignore the collector, chances are your situation may get worse. As stated in the article, the collector could continuously keep contacting you or even file a judgment. It’s best to nip the situation in the bud.”

Monderine affirms that his collection agency does not use harassing or abusive tactics for collection.
