On January 21, 2013, collection agency Rapid Recovery Solution, released a statement following a Minneapolis-St. Paul Business Journal article by Mark Reilly, regarding the new bill that is being pushed to toughen debt collection rules in Minnesota.
According to the Minneapolis-St.Paul Business Journal article, “Minnesota would make it tougher for debt collectors to go after any old "Jane Smith" unless they can prove that she's really the Jane Smith who owes them money.”
The article states that the a new bill being brought about by state Attorney General Lori Swanson, would make companies bring proof to court that the information they have on a debtor is good information. The bill was put into motion due to a law suit against Midland Funding “robo-signing” affidavits for collection lawsuits, and lying about having proof of consumer debts.
The article mentions that some of the collection agencies in Minnesota are not opposed to the bill. According to the Minnesota Association of Collectors, “much of the problem stems from companies that buy up uncollected debt from others, rather than primary debt collectors.”
John Monderine, CEO of collection agency, Rapid Recovery Solution, expressed his thoughts on the recent bill being pushed to toughen collection. “Boundaries have to be set up, or rogue agencies will be trying to unlawfully collect debts,” said Monderine. “This bill will bring the amount of unlawful collection down for sure, so overall it is good bill to have pass.”
