Armed with new Congressional authority and powerful new investigative tools, the government’s enforcement actions against corporate fraud have reached unprecedented levels and now typically involve a web of parallel proceedings.

Parallel fraud actions have reached unprecedented levels, and the 15th Annual Sedona Conference on Complex Litigation is exploring strategies for handling these complex proceedings at a special invitation-only meeting on May 2 and 3, 2013, in Del Mar, California.

Sedona Conference founder and board chair Richard Braman said, "Armed with new Congressional authority and powerful new investigative tools, the government’s enforcement actions against corporate fraud have reached unprecedented levels and now typically involve a web of parallel proceedings – simultaneous or successive criminal, civil, and administrative proceedings against companies and their executives." Braman added that these parallel proceedings are "expected only to increase during a second Obama Administration. They raise critical strategic and tactical considerations for even the most seasoned litigators."

The Sedona Conference®, the leading non-partisan, non-profit law and policy think tank, has pulled together an extraordinary faculty of litigators and judges to address strategic and tactical decision-making in parallel fraud proceedings. Their names read like a Who’s Who of lawyers and jurists handling these complex matters – Filip, Gorelick, Khuzami, MacBride, Rakoff, Richter and Wells.

Faculty co-chairs Neil MacBride, US Attorney for the Eastern District of Virginia; and John Richter, a former US Attorney who once headed the Justice Department’s Criminal Division and is now with King & Spalding, head an all-star faculty including:

• Mark Filip, a former acting Attorney General of the United States, now with Kirkland & Ellis LLP, who lead BPs defense in the Deepwater Horizon oil rig explosion;
• Jamie Gorelick, a former Deputy US Attorney General who served on the 9/11 Commission, now with WilmerHale;
• Robert Khuzami, who just stepped down as Director of the Division of Enforcement of the U.S. Securities and Exchange Commission;
• Hon. Jed Rakoff of the Southern District of New York; and
• Theodore V. Wells Jr., who co-chairs the litigation department at Paul, Weiss, Rifkind, Wharton & Garrison LLP and represented such high profile defendants as U.S. Senator Robert Torricelli; investment banker Frank Quattrone; I. Lewis “Scooter” Libby, chief of staff to former Vice President Dick Cheney; and former New York Governor Eliot Spitzer.

The faculty will engage conference participants in "Sedona-style" dialogue concerning the latest thinking, strategy, tactics, and policy regarding parallel proceedings exploring such topics as:

• Government fraud enforcement initiatives, priorities, and actions
• Understanding the new investigative techniques
• Use of the False Claims Act by the government to recover money lost to fraud where the government is the victim
• The rise of civil qui tam lawsuits and the impact of those filings
• International parallel proceedings
• Practical strategies to mitigate enforcement, sanctions, and sentences
• Ethical considerations in parallel proceedings
• Advising officers, directors, and employees in the context of parallel criminal, civil, and administrative actions

The conference will be held Thursday and Friday, May 2-3, 2013, in Del Mar, California, at the picturesque L'Auberge Del Mar just north of San Diego. The conference begins promptly at 8:30 a.m. o Thursday, and ends with a grab-and-go lunch at 1:00 pm on Friday.

Due to the special nature of this conference, registration is by invitation only and is limited to 45 participants to ensure an intimate environment conducive to meaningful dialogue. The Sedona Conference® will be applying for 11 MCLE hours, including one hour of ethics credit.
