A Texas woman being represented by the experienced product liability law firm of Wright & Schulte LLC has filed a Skechers lawsuit after she suffered a blood clot due to a fall she alleges was caused by the shoe’s rocker bottom sole (Case No. 3:13-cv-00168-TBR). According to the Skechers lawsuit filed by Wright & Schulte LLC, the Plaintiff purchased her Skechers Shape-Ups after viewing television and print advertisements that touted the benefits of toning shoes. This advertising, which prominently featured celebrity endorsers including Kim Kardashian, Joe Montana, Karl Malone and Brooke Burke, promised Skechers Shape-Ups would enable the wearer to “Shape Up While You Walk,” and “Get in Shape without Setting Foot in a Gym.” After initially wearing the shoes for 25-45 minute period for two weeks, the Plaintiff began wearing Skechers Shape-Ups during her daily activities.
According to the Skechers Lawsuit (Case No. 3:13-cv-00168-TBR) On March 20, 2011, the Plaintiff was walking down a ramp when her Skechers Shape-Up rolled forward suddenly and without warning, and caused her to fall on her left knee, shoulder, and palm. The following day, a blood clot was discovered in the Plaintiff’s left knee, and a subsequent attempt to drain the clot proved unsuccessful. For three weeks, the Plaintiff was forced to wear a stiff brace while waiting for the clot to drain. According to her Skechers lawsuit, once the clot was drained, it was discovered that the brace had left her knee too stiff to bend, and she was required to undergo a total knee replacement. During that procedure, the Plaintiff suffered an allergic reaction to pain medication which resulted in disorientation, low blood pressure, blood transfusions, and memory loss.
The Skechers lawsuit alleges that Skechers Shape-Ups are defective due to their rocker bottom sole, which altered the Plaintiff’s gait and caused severe lateral instability. The complaint points out that that as of May 2011, Consumer Reports had documented that Skechers had seen more reports of injuries or complaints than any other product in its database. It further points out that that a 2010 study commissioned by the American Council on Exercise (ACE) raised serious questions about the efficacy and safety of toning shoes like Shape-Ups.
Skechers Shape-Ups were introduced in 2009, and quickly became the market leader in the toning footwear category, according to the U.S. Federal Trade Commission (FTC). However, in May 2012 Skechers USA agreed to pay $40 million to settle FTC charges that the company deceived consumers by making unfounded claims that Shape-Ups would help people lose weight, and strengthen and tone their buttocks, legs and abdominal muscles. While the FTC settlement provided consumers with refunds for the purchase of their shoes, it did not include compensation for injuries allegedly caused by Skechers Shape-Ups.
