Skechers Bone Fractures & Allegedly Dangerous Toning Shoes

According to court documents, the plaintiffs purchased Skechers Shape-Ups after being swayed by various ads that touted the alleged health benefits of these toning shoes. Improving muscle tone, promoting weight loss and helping wearers get in shape without going to the gym were among the alleged health benefits of Shape-Ups claimed in Skechers ads.

Although Skechers ads alleged that their Shape-Ups offered consumers many health benefits, an independent study overseen by the American Council on Exercise (ACE) at the University of Wisconsin found that, “there is simply no evidence to support the claims that these shoes will help wearers exercise more intensely, burn more calories or improve muscle strength and tone.” (http://www.acefitness.org/getfit/studies/toningshoes072010.pdf ) In fact, the Consumer Product Safety Commission (CPSC) has received more reports of Skechers toning shoe injuries than injury reports for any other product in its database (as of May 2011). According to the complaints for all of these cases, consumers were allegedly wearing their toning shoes while performing their daily activities when the rocker bottom of the shoe rolled inappropriately, causing them to fall and sustain at least one bone fracture.

A case filed on behalf of a woman from Surprise, Arizona (Case No. 3:13-cv-00120) alleges that wearing Shape-Ups caused her to fall and sustain multiple fractures in her right ankle. A complaint filed by a Dahlonega, Georgia woman (Case No. 3:13-cv-00113) contends that unstable Shape-Ups caused her to fracture her right ankle in two places; these Skechers ankle injuries required two surgeries and have caused the plaintiff intense pain every day since the fall. A third Skechers lawsuit filed on behalf of a Colorado man (Case No. 3:13-cv-00125) alleges that the defective design of Shape-Ups caused him to fracture his left ankle, which required the implantation of a screw in the broken ankle.

Three additional Skechers lawsuits filed by Wright & Schulte allege that plaintiffs have suffered from other types of bone fractures due to wearing unsafe Shape-Ups. While one claim from an Indiana woman alleges that wearing Shape-Ups caused her to fracture her elbow (Case No. 3:13-cv-00088), another Indiana woman’s Skechers lawsuit contends that use of Shape-Ups caused her to fracture her wrist. Similarly, a woman from Illinois has filed a Skechers lawsuit, alleging that unstable Shape-Ups caused her to sustain multiple fractures in her hand.
