Field service technicians...do not fit within any of the legal exemptions provided by the FLSA

On March 15, 2013, Plaintiff Jonathan Feldman filed an action in the United States District Court for the Southern District of Indiana against Midwest Systems & Services, Inc., Robert Graper, and Lon Evans seeking unpaid overtime pay on behalf of himself and others similarly situated. The Complaint alleges that Plaintiff Feldman was not paid proper overtime pay for his overtime hours worked as a field service technician, installing and servicing security and communication devices for Defendants.
The case alleges that Midwest Systems & Services, Inc. violated the federal Fair Labor Standards Act (“FLSA”) and was filed on behalf of current and former field service technicians who work or have worked for Midwest Systems & Services, Inc. Specifically, the Complaint alleges that Plaintiff Feldman and those similarly situated were misclassified as exempt from the overtime provisions of the FLSA. Thus, the Complaint alleges that Defendants failed to pay field service technicians overtime at the statutorily prescribed rate of one and one-half times their regular rates of pay for those hours worked in excess of forty in a workweek.
Plaintiff’s attorney Phil Gibbons stated, “Field service technicians employed by Midwest Systems & Services, Inc. primarily perform manual labor duties. They do not fit within any of the legal exemptions provided by the FLSA.”
