The product liability lawyers at Wright & Schulte, LLC have filed a multiple plantiff Imprelis lawsuit on behalf of 28 property owners in Ohio, Iowa, Indiana, Missouri and Pennsylvania. These Imprelis Lawsuits(case no. N13C-04-039 EMD) were filed on April 3, 2013 and names E.I. DuPont De Nemours and Co. as the defendant. As with previously filed Wright & Schulte Imprelis lawsuits, this case will be litigated in the Superior Court of Delaware, New Castle County. These Imprelis lawsuits contend that the plaintiffs’ trees and other plant life were permanently damaged after being treated with DuPont’s Imprelis. These cases also alleges that DuPont falsely advertised the safety and effectiveness of Imprelis to consumers and that the company was negligent in admitting the dangers associated with Imprelis even after a number of consumers had reported Imprelis tree damage.

Although many Imprelis tree damage lawsuits filed on behalf of individuals and corporations alike have been consolidated into an Imprelis class action lawsuit that is being litigated in a federal court in Philadelphia, (Case No. 11-md-2284), many individuals are choosing to not join the Imprelis class action lawsuit and, instead, to file individual Imprelis lawsuits against DuPont. Regardless of how plaintiffs are choosing to sue DuPont, Richard Schulte, a partner with Wright & Schulte LLC, has stated that the Imprelis settlement offers DuPont has made to date are insufficient to cover the extensive costs caused by Imprelis tree damage. “None of our clients are participating in the settlements because the offers are inadequate,” stated Mr. Schulte.

According to court documents, the property owners in this lawsuit hired various landscaping or lawn care companies in their respective states throughout the spring of 2011. While each of the lawn care companies had reportedly applied Imprelis as specified by DuPont, within months of the Imprelis application, the plaintiffs’ trees and other plant life had all reportedly sustained severe damage; for some plaintiffs, a single application of Imprelis was allegedly sufficient to cause such devastation. Browning, curling, twisting, stunted leaf growth and stem die-back are among the signs of Imprelis tree damage and death reportedly affecting plaintiffs’ plant life.

Alleged Imprelis Tree Damage
Marketed as the “most advanced turf herbicide in over 40 years,” Imprelis was touted by DuPont as having significant advantages over other herbicides on the market, according to court documents. In the face of such claims, however, landscape professionals have described Imprelis, an herbicide that is reportedly four times stronger than Agent Orange, as the industry’s “Hurricane Katrina.” Many industry professionals also contend that the full extent of the damage DuPont’s Imprelis has caused is only just beginning to become evident.
