According to court filings, plaintiffs who have moved for the establishment of a multidistrict litigation for Stryker Rejuvenate lawsuits assert that the litigation surrounding the recall will be quite large. They have proposed that the consolidated proceeding be established in the U.S. District Court, District of Minnesota, or U.S. District Court, Northern District of Illinois. For its part, Stryker has said in court papers that it supported the transfer of Rejuvenate cases to the District of Minnesota, which has the highest number of Stryker hip recall lawsuit filings of any federal district.
Court documents show that at least 145 Stryker hip recall lawsuits are already pending in a consolidated litigation underway in Bergen County Superior Court, New Jersey. According to the Stryker hip recall notice, the Rejuvenate and ABG II hip stems are prone to fretting and corrosion at the modular neck junction. This may cause Stryker hip stem recipients to experience pain, swelling, and adverse local tissue reactions. However, some Stryker hip replacement recall patients have been found to have high levels of metal ions in their blood, even though they experienced no such symptoms. As such, Stryker has advised all individuals affected by the Stryker Rejuvenate recall to undergo metal ion blood testing and imaging screenings, even if they are not experiencing problems with their hip.
