A Wallin & Klarich client was recently able to avoid spending 20 years in prison after being charged with both sexual assault and child endangerment. The client was represented by experienced criminal defense attorney, David E. Wohl of Wallin & Klarich, who fought to protect the rights of the client by negotiating with the District Attorney and hiring an expert psychological examiner. As a result of David E. Wohl’s efforts, the client was not sentenced to a 20 year prison term.

According to Orange County Superior Court record, the client was charged with sexual assault under California Penal Code section 289 and 220. He was also charged with False Imprisonment under section 236 and child endangerment under California Penal Code section 273a. If convicted of both offenses, the client was facing a sentence of twenty years in the state prison. After realizing that he would face substantial punishment if convicted, the client sought out the assistance of David E. Wohl, to help him fight against the criminal charges and avoid the possible severe consequences.
Mr. Wohl quickly stepped into action and began to examine the facts and circumstances of the case. As part of his defense, Mr. Wohl hired a top psychological evaluator to examine the client according to court record. After examining the client, the psychological evaluator found that the client did not present or bring up any psychological concerns. The psychological evaluator supported the Mr. Wohl’s defense and concluded that the client was a good citizen and should not be sentenced to 20 years in prison.
Mr. Wohl ultimately was able to convince the District Attorney that the case filed against the client was overcharged and the sentence was too harsh under the circumstances of the case according to court documents. As a result, the District Attorney dropped all of the charges against the client for sexual assault under California Penal Code section 243.4. Instead, the client pled guilty to three misdemeanor counts of child endangerment, a much lesser offense that carried a substantially lighter sentence. As a result of the convictions, the client did not spend time in jail and did not have to register as a sex offender. Mr. Wohl’s efforts substantially reduced the penalties the client faced and the negative effect the penalties could have had on the client’s life for many years to come.
