Music Festival Death May Bring Lawsuit

An employee of the Coachella Valley was struck on his motorcycle and killed by a car driven by a man who may have been using illegal drugs last week. Personal injury lawyer John Tenn says the accident is likely to bring a lawsuit.

Celebrating music and culture involved tragedy last week when an employee of the Coachella Music and Arts Festival was struck by a car and killed while riding his motorcycle according to Complex Rides (April 22, 2013). Attorney John Tenn, who focuses his practice on NH car and motorcycle accidents, says that the incident will almost certainly raise a lawsuit – but probably not against the festival.

The accident occurred in the early morning. Employee Monte Gardner, who directed traffic for the festival, was arriving for work when he was stuck by a car. Gardner died in the hospital shortly after as stated in Complex Rides.

The car's driver, David Brennan, was arrested on the suspicion of driving while under the influence of a controlled substance.

“Not all vehicle collisions have a clear victim and a clearly negligent driver,” said Tenn, who believes Gardner's family may sue Brennan. “But in a case where one driver was using illegal drugs, it's obvious that they posed a danger on the road.”

If the drug charges are proven, Tenn says Brennan could be liable for medical bills, pain and suffering, and the financial loss to Gardner's family.

“Obviously no amount of money will restore the loss of a human being,” Tenn said. “But his family should not be left with bills on top of this tragedy.”

Tenn says it's unlikely that the festival itself will be involved in the lawsuit unless the facts indicate it bears some responsibility.

“From the preliminary reports, the collision happened off premises and there does not appear to be negligence from the music festival. This injury claim is likely to be limited between the two families.”
