A Wallin & Klarich client recently was able to get charges for sexual battery dismissed by the court, and as a result avoid jail time. The client also avoided having to register as a sex offender for the rest of his life, which would have been required if he had been convicted of the sexual battery charges. The client was represented by experienced and knowledgeable criminal defense attorney, Matthew B. Wallin, who vigorously fought for the client’s rights through every step of the legal process.

According to court record from El Monte Courthouse, the client was charged with sexual battery pursuant to California Penal Code section 243.4(e)(1), and faced up to six months in jail if convicted. In addition, if convicted, the client would have been required to register as a sex offender for the rest of his life, pursuant to California Penal Code section 290. To fight against the criminal charges, the client sought out the assistance of Mr. Wallin, who is experienced in dealing with sexual battery cases in California.
After discussing the circumstances of the case with the client, Mr. Wallin contacted a recognized clinical and forensic psychologist, who was well-versed in conducting psychosexual assessments according to court documents. Mr. Wallin worked closely with the psychologist to set up times for medical evaluations of the client. After reviewing the law enforcement reports and medical evaluations, Mr. Wallin was able to present evidence that persuaded the prosecutor and judge to dismiss the sexual battery charges. Mr. Wallin used the medical examinations to explain to the prosecutor and judge that given the client’s youth and lack of sexual deviance in the past, mandatory sex offender registration would have catastrophic consequences for his future employment and his ability to parent his infant son. Mr. Wallin aggressively advocated for his client and ultimately was able to get the sexual battery charges against the client dismissed.
As a result of Mr. Wallin’s legal assistance, the client was not required to register as a sex offender pursuant to California Penal Code section 290, and was not required to serve any time in custody according to court record. The client can now be involved in his son’s life and can pursue future employment to help support his family.
