Alleged Skechers Knee Injuries
According to each Skechers Lawsuit, the plaintiffs were allegedly wearing their toning shoes while performing their daily activities when the unstable rocker bottom of the shoe suddenly caused them to fall and sustain a torn meniscus. A torn meniscus is common, yet extremely painful knee injury that occurs when the cartilage (i.e., the meniscus) that acts as a cushion between the shinbone and thighbones is torn. When a person sustains a torn meniscus, their knee suddenly loses stability and will immediately swell up and cause the injured person intense pain. While some cases of torn meniscuses can be repaired with physical therapy, in more severe cases, surgery is needed to repair a torn meniscus.

The plaintiffs involved in the Skechers lawsuit include a Maryland woman (case no. 3:13-cv-00350-TBR); a West Virginia woman (case no. 3:13-cv-00346-TBR); two Mississippi women (case no. 3:13-cv-00330-TBR and case no. 3:13-cv-00328-TBR); and a Wisconsin woman (case no. 3:13-cv-00344-TBR).

Skechers Pays $40 Million Settlement for Misleading Consumers on Alleged Safety of Toning Shoes
According to court documents, the plaintiffs of these Skechers injury lawsuits purchased Shape-Ups after being swayed by various ads that touted the alleged health benefits of these toning shoes (including that they improved muscle tone and helped wearers get in shape without going to the gym). However, an independent study overseen by the American Council on Exercise (ACE) found that, “there is simply no evidence to support the claims that these shoes will help wearers exercise more intensely, burn more calories or improve muscle strength and tone.” [acefitness.org/getfit/studies/toningshoes072010.pdf July 2010]

In May 2012, Skechers was legally ordered to pay the Federal Trade Commission $40 million for intentionally misleading consumers in its Shape-Ups advertising. As part of this ruling, the court also found that Skechers failed to alert consumers about the possible risks associated with these toning shoes and that Skechers had not performed sufficient safety testing on Shape-Ups.
