According to the complaint, the client was injured when a driver failed to properly operate her vehicle and struck the client, who was crossing the street, knocking her to the ground and causing her injuries to her back and knee. Although initially diagnosed as a lower back strain, after numerous revisits to the hospital and to her personal doctor, the client was properly diagnosed with a fractured upper vertebra in her back and over the course of several months, the client experienced continued pain in her lower back that prevented her from walking and standing and led her to finally undergo urgent surgery on her back followed by several sessions of steroidal injections and physical therapy. As a result of the debilitating effects of the accident and ensuing medical treatment, the client was totally disabled for a ten-week period and then partially disabled an additional six-weeks where she was unable to work.
