Teen Tragedy Is Liability Tangle, Attorney Says

Two teens were struck by cars when crossing a highway last week, resulting in a fatality. New Hampshire car accident attorney John Tenn says the tragedy has created a difficult legal situation.

Two teenage girls, Sophia Christen, 15, and Lauren Gendrau, 13, were crossing Highway 28 with a group of friends when they were struck by two cars heading north. Police say Christen was hit by both vehicles, while Gendrau was struck by only one car. Christen was airlifted to a hospital and, tragically, passed away the next morning. The teens had just come from a carnival being held in a nearby parking lot according to an article published by the New Hampshire Union Leader (5.4.13).

Despite the tragic result of the accident, car accident attorney John Tenn says the family’s chances for recovery through a lawsuit are currently unclear.

Tenn, whose practice focuses on helping accident victims recover for their injuries, says normally the victim of an accident like this could successfully sue – but this case is not so clear.

“The details released by authorities do not clearly indicate who was at fault,” said Tenn. “While it is easy to blame teenage victims by assuming that they weren’t paying close attention when crossing roads, I haven’t seen any evidence indicating that the girls made a bad call.”

Moreover, if the drivers were speeding or somehow impaired, Tenn says the girls' families may have a case against them for Gendrau’s injuries and Christen’s tragic death.“It really will come down to the police report,” he said.

The Accident Reconstruction Team of the Derry Police Department is working to determine the cause. Tenn recommends that the families to speak to an experienced injury attorney as soon as possible.

“Grief takes time, but legal deadlines move quickly,” he said. “Victims and their families should review the legal aspects of the situation as soon as possible.”
