As part of the EPA Notice of Proposed Rulemaking (NPRM) for RIN integrity, QAP providers were required to submit details of their QAP-A replacement plans to the EPA by May 1, 2013. Under the NPRM, the QAP-A RIN provides an obligated party zero liability if the RIN is ever to be found invalid. Genscape’s QAP-A RIN replacement backstop was reviewed and approved by the EPA for the interim period. As the biodiesel industry evaluates the impact of the EPA’s NPRM, the demand for biodiesel A-RINs is increasing. Genscape reports that, as of early May, over 80 million A-RINs are stipulated in producer contracts and scheduled to be verified under the Genscape QAP program. It is becoming apparent that A-RINs offer other advantages in the marketplace. With the increased RVOs for 2013, some obligated parties have communicated the need to expand their RIN buying strategy. As obligated parties work to purchase more RINs, many are finding that A-RINs offer a faster and simpler counterparty pathway because they are risk-free. As such, obligated parties can buy the RINs outright and reduce the internal finance approval processes.
