Cheerleading Companies Campus Teamwear and Team Cheer Settle Trademark Infringement Case

We have a distinct voice in the cheerleading apparel industry, and this settlement allows us to continue distributing products that are unique.

A settlement has been reached out of court in a trademark infringement lawsuit filed by Campus Teamwear, Inc. (“CTW”) against Team Cheer (“Team Cheer”).

On September 21, 2012, CTW commenced an action against Team Cheer in the United States Court for the Southern District of California, case number 3:2012cv02310, alleging federal trademark infringement, copyright infringement and unfair competition, among other things relating to Team Cheer’s manufacture of certain apparel, including t-shirts, socks and bags. The parties have reached a confidential settlement, whereby Team Cheer has agreed to stop the sale of those products.

This case highlights the problem of trademark infringement of apparel designs in the cheer industry.

“We are serious about our commitment to protecting our designs and maintaining the integrity of our brand as a whole,” stated Jessica Rzeszut, marketing specialist at Campus Teamwear. “We will continue to fight the exploitation of our creative portfolio and educate consumers so that our distinct voice in the cheerleading apparel industry is not compromised.”

For the past two decades, Campus Teamwear has provided affordable and high-performance cheerleading apparel and accessories to cheerleaders of all ages. In March 2013, the leading cheer gear retailer released a new line of products for the spring season.

“What’s most important is that our customers understand the difference between our authentic products and those that are copycats,” continued Rzeszut. “Consumers may receive products that seem identical to ours in design, but don’t offer our quality guarantee. When our designs are paired with poor quality from other companies, the result is a negative reflection of our brand.”

Campus Teamwear encourages cheerleading coaches and other purchasers for the sport to do their research, inquire about quality guarantees, and to report issues via product reviews on the website of the company that supplied their products.
