Two male nurses were paid a rate of $1300 a day to take care of a 98-year-old female stroke victim in her home. Despite the pay, the patient's family suspected she was not being cared for properly. The family viewed video from security cameras in the room and what they saw was the two male nurses repeatedly performing sexual acts with and beside the victim, reported CBS News. Said New York civil rights violation lawyer David Perecman, hundreds of elder abuse cases in New York and elsewhere are missed each year. This family recognized and took seriously the signs of elder abuse. They watched the video to see what was going on when they weren’t around and were able to stop the abuse.

“Elder abuse is often difficult to expose. The reason in-home caregivers are hired is to provide relief to busy family members and friends who have a hard time visiting with an aging individual on an every day basis. It is often difficult for family members to learn about the actual quality of care provided because an incorrect impression can too easily be given,” said Perecman.

In the video posted by CBS News, the two nurses can be seen in the patient’s bedroom fondling each other. At times they touch her while engaging in sexual behavior.

“Elder abuse is as deplorable as child abuse. Like children, many elderly individuals, for reasons such as illness, are to some extent dependent on others and helpless to protect themselves,” said Perecman, founder of The Perecman Firm, one of New York’s civil rights violation law firms. “Families and friends of the elderly must remain vigilant to ensure vulnerable loved ones are not mistreated.”

According to a New York State data on elder abuse, 19,301 cases of elder abuse were referred to Adult Protective Services (APS) in 2008. APS is the primary recipient of elder abuse reports in New York State. Factoring in the 5:1 underreporting ratio from a 1998 National Center on Elder Abuse study resulted in an estimated incidence of elder abuse in NYS of 33,875.

Criminal charges against the nurses, Russel Torralba and Alfredo Ruiz, are being considered, reported CBS News.
