Jury selection is presently underway in the case of Cooper v. Takeda Pharmaceuticals America Inc. (CGC-12-518535, California Superior Court of Los Angeles), according to a February 19th Bloomberg article. The case surrounds 69-year-old Jack Cooper, a former Pacific Bell employee who developed bladder cancer in November 2011. Cooper contends that his bladder cancer came as a result of Actos use, and that the drug’s manufacturer—Takeda Pharmaceuticals—failed to properly warn consumers about the dangers associated with Actos use.
Takeda disputes the charges against them. “We empathize with the plaintiffs but believe that Takeda acted responsibly with regard to Actos,” D’Lesli Davis, one of Takeda’s lawyers, said in an emailed statement to Bloomberg. “Studies do not establish a causal link between Actos and bladder cancer.”
The U.S. Food and Drug Administration has also warned the public that Actos use may be associated with a heightened risk of bladder cancer when used for a period longer than one year. The warning was issued on June 15, 2011, and was inspired in part by a French epidemiological study, which ultimately led to a nationwide ban of Actos in France.
