Rottenstein Law Group Recommends DePuy Hip Replacement Recipients Consult New Doctors About Revision Surgery

(Vocus) November 15, 2010 -- Rochelle Rottenstein, principal of the Rottenstein Law Group, notes that many clients with recalled DePuy ASR replacement hip devices have certain common concerns. “These are intelligent questions,” Rottenstein remarks, “to which every recipient of a recalled device should have the answers. And no victim should feel the least bit shy about discussing these topics with doctors. It’s the patient’s health that’s most important, after all.”

Rottenstein has found that clients want to know, specifically, whether the surgeon who installed the DePuy ASR device should perform the revision surgery to replace the faulty, dangerous device. Clients also want to know whether they will be required to receive a new hip replacement device manufactured by DePuy. And they ask how they can learn whether their doctors are affiliated with DePuy or have any financial interest in the company.

Rottenstein recommends at least consulting a doctor or surgeon other than the one who implanted the faulty DePuy ASR device. “Some surgeons are paid as consultants to DePuy. These doctors will likely use DePuy products primarily, if not exclusively. A patient with a longstanding relationship with an orthopedist will probably want to maintain that relationship, but it will not hurt to get a second opinion.”

“There are several other replacement hip systems available made by manufacturers other than DePuy,” Rottenstein says, addressing the second common question. “A patient who does not trust DePuy has alternatives. These alternatives can be discussed with an orthopedist who has no loyalty to DePuy or who will put any loyalty to DePuy behind his or her patients’ best interests.”

Rottenstein recommends reviewing the list of paid consultants identified on DePuy’s Web site, although she notes that the list reports only consultants who received payments from the company between January 2009 and September 2010. Not shown are those who have received payments before or since that period. “If you can learn whether your doctor has done research, you should also be able to learn who sponsored that research,” says Rottenstein. “You might even ask a second doctor to tell you about the credentials of the first. And by all means you should be wary of any attempt on any doctor’s part to dissuade you from legal action against DePuy. This could be an indication of where your doctor’s loyalties are.”
