DePuy ASR hip lawsuits continue to move forward in litigations throughout the country, Bernstein Liebhard LLP reports. According to documents posted on the Court’s website, a New Case Management Order has been issued in the DePuy ASR hip litigation underway in New Jersey Superior Court that addresses, among other things, the selection of cases for the litigation’s first trials. Court records indicate that 637 DePuy ASR lawsuits have been filed so far in the New Jersey proceeding. (In Re DePuy ASR Hip Implants Litigation, BER-L-3971-11)

DePuy ASR Hip Recall
The DePuy ASR hip recall was announced in August 2010, after the metal-on-metal hip implants were found to be failing in 12-13% of recipients within just five years of implantation. However, The New York Times recently reported that court documents unsealed in one DePuy ASR lawsuit included an internal analysis conducted by Johnson & Johnson in 2011 that indicated the recalled hip implants are likely to fail in nearly 40% of recipients within just 5 years of implantation.*
Court records indicate that there are more than 10,000 DePuy ASR lawsuits currently pending in courts throughout the U.S. Most of those lawsuits have been filed in a multidistrict litigation underway in U.S. District Court, Northern District of Ohio, where Bernstein Liebhard LLP is actively filing claims. In March, a Los Angeles Superior Court jury awarded more than $8 million to a plaintiff in the nation’s first trial of a DePuy ASR lawsuit (Kransky v. DePuy, BC456086, California Superior Court, Los Angeles County). However, earlier this week, a jury in Chicago found for Johnson & Johnson in a second trial (Strum v. DePuy, 2011-L-9352, Circuit Court of Cook County). According to a report from The New York Times, documents disclosed in the course of both proceedings indicated that Johnson & Johnson and DePuy knew that the ASR was defective years before the recall was announced in 2010. However, that information was not shared with the public or the medical community.**
