Bernstein Liebhard LLP notes that the first trial of thousands of DePuy ASR hip replacement lawsuits in Ohio federal court has been rescheduled for June 3, 2013. According to an Order dated April 19th, a final pretrial meeting will be held on May 14th, and jury selection is to begin on May 30th. Court documents indicate that some 10,750 lawsuits stemming from the DePuy ASR hip recall have been filed in courts throughout the country. Three-quarters of those claims are pending in the multidistrict litigation underway in U.S. District Court, Northern District of Ohio. (In re: DePuy Orthopaedics, Inc. DePuy ASR hip replacement lawsuits have been mounting since Johnson & Johnson and its DePuy Orthopaedics unit recalled the metal-on-metal hip implants in August 2010 after they were found to have an unacceptably high failure rate. At the time of the DePuy ASR hip recall, some 93,000 hip implants had been sold worldwide, including about 37,000 in the U.S. Plaintiffs in DePuy ASR lawsuits allege the devices can shed dangerous amounts of metal ions into the surrounding tissue and blood stream, leading to early device failure, metallosis and other serious complications.*
In addition to the thousands of DePuy ASR hip replacement lawsuits pending in the federal litigation, hundreds of others have been filed in various state courts throughout the country. In March, the nation’s first trial involving the DePuy ASR hip recall ended with a Los Angeles Superior Court jury awarding more than $8 million to a plaintiff (Kransky v. DePuy, BC456086, California Superior Court, Los Angeles County). Earlier this month, a jury in Chicago found for Johnson & Johnson in a second trial (Strum v. DePuy, 2011-L-9352, Circuit Court of Cook County). According to a report from The New York Times, documents disclosed in the course of both trials indicated that the Defendants knew that the ASR was defective years before the recall was announced. However, that information was not shared with the public or the medical community.**
