DePuy Pinnacle hip replacement lawsuits continue to mount in the federal multidistrict litigation now underway in U.S. District Court, Northern District of Texas, Bernstein Liebhard LLP reports. According to a Master Case List issued by the Court on May 1, 2013, 4,087 DePuy hip lawsuits involving a metal-on-metal version of the DePuy Pinnacle Hip Replacement System are now pending in the proceeding. DePuy Pinnacle Hip Replacement Lawsuits
According to court documents, plaintiffs in DePuy hip lawsuits involving the all-metal Pinnacle allege the device is prone to wear and can shed dangerous amounts of metal debris, leading to premature implant failure, metallosis and other debilitating complications. The lawsuits further allege that the Pinnacle hip replacements suffer from the same design defects that prompted the 2010 DePuy ASR hip recall, and question whether they should have been recalled as well. Court records indicate that the first trials in the federal DePuy Pinnacle litigation will begin in September 2014.
The U.S. Food & Drug Administration (FDA) is currently reviewing the safety of metal-on-metal hips like the all-metal Pinnacle, in which the ball and cup are made from a chromium-cobalt alloy. In January, the agency proposed an order that would make these devices ineligible for 510(K) clearance, which allowed such implants to come to market with no human testing. The FDA has also recommended that doctors consider metal ion testing for all-metal hip replacement patients who are experiencing symptoms of a failing implant, including pain, swelling, loosening of the implant, or change in the ability to walk.*
