Mirena IUD Lawsuits Move Forward, as Bernstein Liebhard LLP Notes Issuance of New Order in Federal Mirena Litigation

Mirena IUD lawsuits continue to move forward in a federal multidistrict litigation established in U.S. District Court, Southern District of New York, Bernstein Liebhard LLP reports. According to an Order issued on May 3rd, the Court is preparing to consider the appointment of plaintiffs’ attorneys to leadership positions in the litigation. The proceeding’s first Status Conference has been scheduled for May 17th, the Order stated. (In re: Mirena IUD Products Liability Litigation, MDL No. 2434)

Mirena Lawsuits
The federal Mirena litigation was established by the U.S. Judicial Panel on Multidistrict Litigation via a Transfer Order dated April 8th. When the Transfer Order was issued, more than 40 Mirena IUD lawsuits had already been filed in 17 federal jurisdictions. All of the claims allege the Mirena IUD migrated away from its original position in the uterus, leading to uterine perforations and other serious injuries, which in many cases required risky Mirena removal surgery. Plaintiffs further allege Bayer Healthcare Pharmaceuticals failed to provide adequate warnings regarding the risk of device migration and related Mirena complications.

Dozens of additional Mirena lawsuits have been filed in state courts throughout the country. Court documents indicate Bayer petitioned the New Jersey Supreme Court last year for the establishment of a consolidated litigation in Middlesex County Superior Court for Mirena claims filed in that state. While the request was rejected, plaintiffs in Mirena IUD lawsuits filed in New Jersey petitioned the Court on March 6th to reconsider that request .*

The Mirena IUD was approved by the U.S. Food & Drug Administration (FDA) as a birth control method in 2000. In 2009, Mirena’s approved uses were expanded to include treatment of heavy menstrual bleeding in women who wish to use an IUD as their method of birth control. In December 2009, the FDA issued a warning letter to Bayer after finding that one of its promotional campaigns for the IUD exaggerated the efficacy of the device and minimized potential Mirena complications. Among other things, the FDA took issue with marketing claims touting Mirena’s purported ability to improve a woman’s sex life and help her “look and feel great.”**
